against unauthorized access, loss or damage.

commitment to the correct compliance with the laws that are applicable, regardless of the
jurisdiction that is applicable depending on the place of residence or from which our website is

foundation we do so, and what rights you have on that basis.

sweepstakes/contest entries, our information practices and the choices you can make about the

Our Privacy Statement on the use of our websites and the AMPLUS Data Protection Policy do not

By using the Site, Application, or Services, you agree to the terms of this Privacy Policy and the
practices described in the Policy, in case of disagreement with the terms and conditions of our
website (including AMPLUS Privacy Policy), we recommend that you do not access our website
since the use of our website in these circumstances would mean that the relationship with AMPLUS
would lack of the necessary legal framework that governs the relationship between both parties.


2. COLLECTING AND PROCESSING YOUR PERSONAL DATA
We may collect and use (either by ourselves or through our trusted service providers or business
partners) information that can be used to identify you or contact you ("Personal Information"). The
information we collect may be of the following nature: (i) Personal Information by asking you to
provide such information, (ii) Personal Information through automated, meaning that are part of
the technology underlying our platform necessary to provide you with our services ("Website

whether you were able to access the website or received an error message); the usage of features

website; and the Web page you visited after visiting our website, whether by clicking links on our
websites or entering a domain directly into the input field of the same tab (or window) of the
browser in which you have our websites open. The storage of any information, whether through
AMPLUS or any third parties (trusted service providers or business partners), is always carried out
in accordance with current legislation and only for duly authorized purposes.
We only process other personal data if you provide this data, e.g. as part of a registration, contact
form, chat, survey, prize competition or for the execution of a contract, and even in these cases
only insofar as this is permitted to us on the basis of a consent.
You are neither legally nor contractually obligated to share your personal information. However,
certain features of our websites may depend on the sharing or personal information. If you do not
provide your personal information in such cases, you may not be able to use those features, or they
may be available with limited functionality.


Email Authentication and One-Time Token Access:
Users acknowledge and agree that access to the customer portal may be provided through onetime
tokens or authentication links sent to the email address registered with their account. The
Company shall not be liable for any unauthorized access, disclosure of partial credit card
information, personal data exposure, or any damages arising from the compromise, unauthorized
use, or loss of control of the user’s email account. Users are solely responsible for maintaining the
security of their email accounts and any devices used to access such accounts.


Collection of IP Address and Location Information:
The Company may collect and process certain technical information, including but not limited to IP
addresses, country information, and regional location data, for legally authorized purposes such as
security, fraud prevention, service optimization, and legal compliance. All such information will be
handled in accordance with applicable data protection laws and regulations, including but not
limited to the General Data Protection Regulation (GDPR), the California Consumer Privacy Act
(CCPA), the Act on the Protection of Personal Information (APPI) of Japan, and other relevant local
privacy laws.
Users may have certain rights regarding their personal data under applicable laws, which may
include the right to request access, correction, deletion, restriction of processing, or other data
subject rights as required by local regulations. The Company will respect and respond to such
requests in accordance with any applicable laws and established procedures.

described above. We are not responsible for the privacy practices of third parties or the content of
linked websites acting maliciously and/or without following our specific instructions. We encourage

Instagram, and Twitter. These third-party features may collect information about your IP address
and which pages of our site you are viewing, and they may set cookies for the purposes described
in their privacy policies. These features are governed by the privacy policies of the companies that
provide them, not this Privacy Policy.


When we use social plug-ins on our websites from social networks such as Facebook and Twitter,
we integrate them as follows:


When you visit our websites, the social plug-ins are deactivated, i.e. no data is transmitted to the
operators of these networks. If you want to use one of the networks, click on the respective social
plug-in to establish a direct connection to the server of the respective network.


If you have a user account on the network and are logged in when you activate the social plug-in,
the network can associate your visit to our websites with your user account. If you want to avoid
this, please log out of the network before activating the social plug-in. When you activate a social
plug-in, the network transfers the content that becomes available directly to your browser, which
integrates it into our websites. In this situation, data transmissions can also take place that are
initiated and controlled by the respective social network. Your connection to a social network, the
data transfers taking place between the network and your system, and your interactions on that

6. TRACKING
In some cases, we may use tracking scripts or "tracers" that recognize unique identifiers from
cookies placed on your hard drive by other websites. These are used to measure the success of our
own advertising and to better understand your interest in other brands and companies with which
AMPLUS partners. For example, we may use tracers to determine whether you have visited a
particular web page on which AMPLUS has placed a banner ad. We do not use tracers to collect
information about your Internet usage that is
unrelated to AMPLUS. We also do not use tracers to identify your personal information, and you
remain anonymous unless and until you communicate with AMPLUS.


7. USER GENERATED CONTENT
Any material that you upload or otherwise submit to our pages, such as data, questions,
comments, ideas, suggestions, etc. ("Submissions") will be treated as non-confidential and nonproprietary
information. By submitting such materials, you grant the Company a non-exclusive,
worldwide, royalty-free, perpetual, and irrevocable license to use, reproduce, modify, distribute,
display, and otherwise exploit such Submissions for legitimate business purposes. This license does
not transfer ownership of your intellectual property rights. In particular, our site may use any ideas,
artwork, inventions, developments, suggestions or concepts contained in any submission you make
to our page for any purpose (including, but not limited to, developing, manufacturing, advertising

provide marketing assistance; search results and links (including paid listings and links), and

purposes necessary to perform their functions.
B) As we develop our business, we may sell or purchase subsidiaries or business units, either
directly or through legal proceedings such as bankruptcy. In such transactions, customer
information is typically one of the business assets transferred, but we will continue to follow
the obligations set forth in our existing privacy policy.
C) We may share customer personal information in the following situations (i) to comply with
legal process or other legal requirements of government authorities; (ii) to protect and defend
our rights or property; (iii) to enforce this Privacy Policy; (iv) to protect the interests of other

D) AMPLUS has several affiliated brands and companies that provide services globally. Similarly,
we use several service providers located around the world. In order to provide you with
services and access to our sites, we may transfer your personal information to jurisdictions
outside of your country of residence, including processing personal information in the United
States. Because this jurisdiction may not maintain the same level of privacy protection as your
place of residence, your use of the Site and Services constitutes your consent to such transfer
of your personal information. Even if we make such a transfer, the obligations of this Privacy
Policy will continue to apply to your personal information, except where prohibited by local
law. Third party service providers are also required to comply with the privacy and security
obligations of this policy as described above.

The Children's Online Privacy Protection Act (COPPA) protects the online privacy and personal
information of children under the age of 13. We respect the privacy of children. The Services are
not intended for children under the age of 13. We do not intentionally solicit or collect personally
identifiable information online from children under the age of 13 without prior verifiable parental
consent. Parents may request access, correction, or deletion of their children's Personal
Information by contacting us. "Personal Information/Opt-Out" to access, change, or delete any

In all cases, any user of our digital services (Customer) falls into one of the following categories: (i)
users of legal age and (ii) users who do not fall into the adult age category but are duly authorized
by their parents or legal guardians; in both cases, the necessary legitimacy is given for the proper
fulfillment of the user's obligations.

The Service may contain links to non-AMPLUS websites. We are not responsible for the privacy
practices or the content of any non-AMPLUS Web site. We have no control over the use of such
web sites. You should exercise caution when deciding to disclose personal information or usergenerated
content on these websites.


User Choices Regarding Collection, Use, and Distribution of Personal Information
You may choose not to provide certain types of personal information to us. However, we do
automatically collect website browsing information, so if you do not want to disclose such
information, please do not browse our site. If you choose not to provide certain information that
you voluntarily choose to disclose, your access to some of the Services may be limited (except
where prohibited by law).
